By creating an account, accessing, or using the Service in any manner, you expressly confirm that you have read, fully understood, and irrevocably agree to be legally bound by this Disclaimer. If you do not agree to these terms, you are prohibited from and must immediately cease all use of the Service.

1. For Informational Purposes Only; Not a Substitute for Professional Advice

The Coach AI is an AI-based tool designed for informational and educational purposes only. It is not a substitute for advice from qualified, licensed professionals.

  1. No Licensed Professional Services: The Service does not provide, and must not be interpreted as providing, any form of medical, psychological, psychiatric, therapeutic, legal, financial, or other regulated professional advice, diagnosis, or treatment.

  2. No Professional-Client Relationship: Your use of the Service does not create a doctor-patient, therapist-client, attorney-client, fiduciary, or any other confidential or professional relationship between you and EnCoCoEU S.L.

  3. Emergency Situations: This Service is not for emergencies. If you are experiencing a medical or mental health crisis, suicidal ideation, or any other emergency, contact your local emergency services (e.g., 112 in Europe) or a qualified professional immediately.

  4. Use at Your Own Sole Risk: Any action or inaction you take based on the outputs of the Service is at your sole and exclusive risk. You are responsible for consulting with appropriate, independently-retained professionals to verify any information before relying on it.

2. Acknowledgment of AI Limitations and User's Sole Responsibility

The Service utilizes machine learning algorithms and has inherent limitations. Outputs are generated without human consciousness, empathy, or professional validation. By using the Service, you explicitly acknowledge and accept the following:

  1. AI Outputs Are Not Facts: Outputs may be inaccurate, incomplete, biased, or inappropriate for your specific circumstances. We do not verify or endorse any output for accuracy, legality, or suitability.

  2. Your Duty of Critical Judgment: You are solely responsible for exercising critical judgment. You must not rely on any output from the Service without first conducting your own independent verification.

  3. You Assume Full Liability: You assume full, total, and complete responsibility for all decisions, actions, and outcomes arising from your use of the Service.

3. Comprehensive Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory. This disclaimer includes, but is not limited to, any warranties of:

  1. Merchantability and fitness for a particular purpose;

  2. Accuracy, completeness, reliability, or timeliness of the Service or its content;

  3. Non-infringement of third-party rights, including intellectual property;

  4. Uninterrupted, secure, or error-free operation;

  5. The absence of viruses or other harmful components;

  6. Achievement of any specific goals, outcomes, or results.

No information, whether oral or written, obtained from the Service shall create any warranty not expressly stated herein.

4. Strict Limitation of Liability

To the fullest extent permitted by Spanish and EU law, EnCoCoEU S.L., together with its affiliates, directors, officers, employees, agents, and licensors, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind. This includes, without limitation:

  1. Loss of income, profits, data, reputation, goodwill, or other intangible losses;

  2. Personal injury, emotional distress, or psychological harm;

  3. Any losses arising from your reliance on AI-generated outputs;

  4. Any losses due to Service interruptions, data loss, or technical failures.

This limitation of liability applies regardless of the legal theory upon which a claim is based (whether contract, tort (including negligence), strict liability, or otherwise), even if we have been advised of the possibility of such damages.

  1. Exceptions under Law: This limitation does not intend to exclude liability for damages arising from our willful misconduct (dolo) or gross negligence (culpa grave), as defined under Spanish law.

  2. Monetary Cap: In any event where liability cannot be fully excluded by law, the total aggregate liability of EnCoCoEU S.L. to you for all claims arising out of or relating to the Service shall be limited to the greater of: (a) the total amount of fees, if any, you paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred euros (€100.00).

5. User Indemnification

You agree to indemnify, defend, and hold harmless EnCoCoEU S.L. and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Service; (b) your violation of this Disclaimer or any applicable law; (c) your infringement of any third-party right, including any intellectual property right; or (d) your reliance on any output from the Service.

6. Age Restriction

The Service is intended exclusively for individuals who are at least eighteen (18) years of age. By using the Service, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into this binding agreement. We do not knowingly collect personal data from individuals under 18.

7. Service Availability

While we endeavor to keep the Service operational, we do not guarantee its availability. The Service may be inaccessible or experience downtime due to maintenance, technical issues, or other factors, some of which are beyond our control. We disclaim all liability for any loss or inconvenience caused by such interruptions.

8. Governing Legal Framework

This Disclaimer must be read in conjunction with our Terms of Service and Privacy Policy. Together, these documents constitute the entire legal agreement between you and EnCoCoEU S.L. regarding the Service and supersede all prior agreements. The Privacy Policy explains our data practices, including the use of third-party services like Google Analytics and Ads.

9. Governing Law and Exclusive Jurisdiction

This Disclaimer is governed by and shall be construed in accordance with the laws of Spain and applicable EU regulations.

You irrevocably agree that the courts of the city of Valencia, Spain, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Disclaimer or the Service. You waive any objection to proceedings in such courts on the grounds of venue or inconvenient forum.

10. Severability and Contact
